Entry Clearance for Children

Children who are dependants of those individuals who have permission to be in the UK as a person with limited leave to remain can apply to join their parent in the UK. In other instances, your child may be eligible to apply for an overseas British passport.

Visitor Visa

If you are a foreign national and require a visa to visit the UK for tourism, business, study, attending certain events or other permitted activities then we can assist you with an application for a ‘visitor visa’.

Generally, visitors in all categories will need to show and evidence the purpose of their visit and that this is permitted. For example, you could visit a family member who is unwell but you would not be permitted to undertake caring duties. Therefore, these types of visas carry some of the highest rates of refusal. Immigration Control

Visitor Visas allow foreign nationals who are subject to immigration control to enter the UK for a short period of time. This period is usually a maximum of six months. A long term (multiple visit) visa can also be obtained for either 2 years, 5 years or even 10 years.

Eligibility

Eligibility to apply for a Visitor’s Visa will depend on what you intend to do whilst you are in the UK. You must show both a genuine reason to enter the UK and also a genuine intention to return to your country of origin. You must also have sufficient funds to support and accommodate yourself and to be able to meet the cost of your return or onward journey, so we recommend a consultation with one of our specialists prior to submitting your application to ensure success.

Spouse, Fiancé/Fiancée /Unmarried Partner Visa

Here at AK Solicitors, we have a wealth of experience in advising clients on the requirements to be met to bring your married or unmarried partners to the UK. We can assist you from the start of your Immigration journey i.e. initial entry into the UK all the way to obtaining settlement in the UK.

In order to live in the UK as a ‘partner’ of a British or settled person, you must satisfy the following requirements:

  • You and your partner are in a ‘genuine and subsisting’ relationship
  • You are both free to marry i.e. any previous marriages have ended
  • You are able to meet the minimum financial requirement of £18,600 per year
  • You and your partner will have access to ‘adequate accommodation’ and
  • You meet the English language requirement (unless exempt)

Some clients will also have to demonstrate that they are free from Tuberculosis. Please contact us to find out whether or not this applies to you.

Most clients will find the financial requirement to be the most difficult obstacle to overcome. The type of evidence which you will be expected to provide will differ depending upon your partner’s employment status. There will be different rules for employed individuals, self-employed individuals and those seeking to rely on cash savings. This is our specialist area and we can advise you on the most appropriate type of visa and method of calculating the financial requirement based on your individual circumstances.

1. Employed Individuals

Your partner must be able to prove that he or she earns a gross annual income of over £18,60. However, there are some exceptions to this:

  • If you have case savings, you may be able to secure a spouse or unmarried partner visa with a lower annual income
    you plan to marry or become civil partners within 6 months of arriving in the UK
  • If you have children or dependents, the financial threshold will increase
  • If you receive ‘permitted benefits’ than you may not need to meet the minimum salary requirements but meet an alternative financial test

1. SAelf-employed Individuals

We can also assist you with applications for those who are self-employed as:

  • Sole trader, partner or in a franchises
  • Contractors
  • Director and/or shareholder of a limited company
  • An employee of a limited company who have family members with a shareholding (directly or indirectly) in the company may be considered self-employed in certain circumstances under the immigration rules

Cash Savings

IIf your partner seeks to rely on cash savings, whether alone (£62.500 or above is required) or in combination with their income then we can assist you with the complex calculations.

If your partner’s level of savings are less than £62,500 but greater than £16,000 then you can combine your savings with your income from employment investments, stocks and shares in order to meet the financial requirement.
